APILOGY is an API marketplace platform managed by PT Telekomunikasi Indonesia Tbk (hereinafter referred to as "TELKOM"). When using Apilogy, users (hereinafter referred to as "you" or "your") are obligated to comply with APILOGY guidelines, rules, or provisions, that might be updated in needed times, which also include and not limited to Apilogy Privacy Policy. By registering and/or using Apilogy services, both its website and application, you have acknowledged, read, understand, and agree to these Terms and Conditions. If you disagree with any part of these Terms and Conditions, you may not access APILOGY services.
1. Definition
In these Terms and Conditions, unless inconsistent with or otherwise indicated by the context:
- a. "Account" means any accounts that have been registered by a user in Apilogy.
- b. "API" or Application Programming Interface is an interface that provides a set of rules, protocols, or tools to let two platforms communicate.
- c. "Application" means a software or computer program that merges features, technology, content, and products that can be downloaded on the App Store and/or Google Play Store.
- d. "Developer" is the party that uses and/or purchases API.
- e. "Developer Site"refers to https://apilogy.id.
- f. "Personal Data"means every valid information that directly and/or indirectly relates to an identified or identifiable living individual, based on one information or a combination of them collected through digital and/or non-digital systems. This information includes but is not limited to one’s name, identity number, phone number, address, electronic credentials, and any other information related to the individual.
- g. "Profile Data"means information related to the user on the Apilogy Profile page.
- h. "Publisher" is the party that creates, registers, and/or sells API in Apilogy.
- i. "Publisher Site"refers to https://publisher.apilogy.id/.
- j. "Service"refers to the Developer Portal used to get the API and the Publisher Portal used to manage API.
- k. "User" is a Publisher or Developer that has registered their account in Apilogy.
2. Conditions of Registration and Access
- a. APILOGY services can only be accessed by users who have registered their Apilogy account.
- b. In order to create an Apilogy account and use Apilogy services, you will be required to provide certain information, including your Personal Information, which at least are:
- i. Full Name;
- ii. Username;
- iii. Password;
- iv. Email; and
- v. Phone Number.
- c. You are responsible for the confidentiality, security and proper use of all security information on your account, including password.
- d. Apilogy services are not intended for anyone who has not reached the age of competence and adulthood, according to Indonesia’s law and jurisdiction. If you lack such capacity (for instance, below 18 years old), you must obtain parental or guardian consent to use Apilogy services. If Apilogy finds any underage users, the user will be the responsibility of the parents or guardian.
- e. Apilogy may reject your account registry and suspend or terminate some or all of the access to Apilogy services if Apilogy finds you provide incorrect, invalid, or incomplete statements, guarantees, information, and/or Personal Data.
- f. Apilogy has the right to assume and treat all activities on your account as activities you consciously carry out.
- g. You are responsible for all losses and legal consequences arising from your negligence in securing the confidentiality of your password and account.
- h. You agree to notify Apilogy immediately regarding any allegations or activities of unauthorized use of the Apilogy account or password and/or other security breaches.
3. Intellectual Property Rights
Intellectual Property Rights related to Apilogy and its services, including but not limited to names, logos, program codes, designs, trademarks, technologies, databases, processes and business models, are protected by copyrights, brands, patents, and other intellectual property rights under the laws of the Republic of Indonesia registered under TELKOM as the respected owner. You or any party outside TELKOM have no rights or permissions, directly or indirectly, to access Apilogy sites to use, reproduce, and/or claim any intellectual property and ownership in it. You may not modify paper or digital copies of any content and materials in Apilogy. If you find any violation of intellectual property rights, you can report it to Apilogy by contacting our Customer Services.
4. Payment
- a. You agree to pay such fees for any paid services settled by Apilogy. The fees listed on Apilogy sites include 11% VAT, according to the regulations in Indonesia. Apilogy can change the service fee without written notification to you and/or APILOGY users.
- b. You agree that Apilogy accepts several payment methods, including Finpay payment codes and virtual accounts.
- c. Apilogy is not responsible for refunding payments if there is a violation of the Terms and Conditions.
5. Prohibition and Responsibility
- a. You warrant that you will not take actions that may be considered attempts to collect, process, and/or disclose data contained in the Apilogy system for purposes that violate laws and regulations.
- b. You warrant that you will not use Apilogy to violate the security or integrity of any network, computer and communication system, software application, and/or computing network or device.
- c. All prohibited actions include accessing or using any system without permission, as well as attempting to investigate, scan, or test a system vulnerability or violating any security or authentication measures.
- d. Apilogy and TELKOM are not responsible for the collection, processing, and/or disclosure outside of Apilogy’s digital system.
6. TELKOM’S Limitation of Liability
- a. You are solely and entirely responsible for your choice to use Apilogy and the services being delivered to you, as shown and available on Apilogy sites.
- b. To the extent permitted by the applicable law, TELKOM (including any subsidiaries, directors, and employees), is not responsible for any damage or loss (including but not limited to loss of money, reputation, profits, or other intangible losses) resulting directly or indirectly from:
- i. You or your inability to use and operate Apilogy services;
- ii. Apilogy service prices provided by the Publisher;
- iii. Delays or disruptions in the application;
- iv. Negligence and losses caused by you and/or your customers;
- v. Violations of Intellectual Property Rights;
- vi. Disputes between you and/or your customers;
- vii. Defamation of other parties;
- viii. Losses caused by unauthorized payments to other parties on behalf of TELKOM or negligence in entering payment account and/or other information done by you and/or the banking party;
- ix. Viruses or other malicious software (including but not limited to bots, scripts, automation tools, and/or hacking tools) obtained by accessing or connecting any platform to Apilogy services;
- x. Any interruptions, bugs, errors, or inaccuracies in the Apilogy services;
- xi. Damages on you and/or your customer’s hardware while using Apilogy services;
- xii. Hacking actions done by a third party to you and/or your customer’s account; and
- xiii. Force Majeure.
- You agree not to hold TELKOM responsible for any damage or loss caused by the stated circumstances.
7. Contact Details for Questions and Complaints
- a. If you have any questions, complaints, and/or suggestions about Apilogy, you might submit your questions, complaints, and/or suggestions along with your contact details by:
- i. Writing APILOGY an email through support@apilogy.id, or
- ii. Visiting APILOGY at: Telkom Digital Valley, 3th Floor Menara Bandung, Jl. Gegerkalong Hilir No. 47, Sukarasa, Sukasari, Bandung.
- b. In the later event that there are additions, reductions, and/or changes to the contact details for complaints, a notification will be made on Apilogy sites.
- c. Apilogy will verify your data and information based on the user information stored in Apilogy’s databases. Apilogy has the right to reject processing your questions, complaints, and/or suggestions if the data provided cannot be verified and/or does not match the user information on Apilogy’s databases.
- d. Apilogy will conduct an examination and/or investigation of your inquiries and will provide answers and/or solutions in accordance with Apilogy’s policies and procedures 2 (two) weeks after Apilogy receives the complete details of the inquiries,
8. Force Majeure
- a. Apilogy and TELKOM shall not be liable for any delay and/or failure to perform resulting from causes outside the reasonable control of TELKOM (hereinafter referred to as "FORCE MAJEURE"). The event that can be categorized as Force Majeure is all circumstances or occurrences beyond Both Parties’ control, including but not limited to riots, epidemics, fires, floods, earthquakes, strikes, wars, sabotages, and enactment of the Republic of Indonesia’s law which limiting or resulting the inability of Both Parties to perform responsibilities stated in theseTerms and Conditions.
- b. If one and/or several events as referred occur, Apilogy and TELKOM are obliged to writtenly notify you through email, sites, and/or application no later than 7 (seven) days after the event occurs.
9. Dispute Resolution
- a. Both Parties agree to resolve any disputes during the subscription contract through deliberation to reach consensus.
- b. If by deliberation, no consensus is reached within 30 (thirty) days or another period as agreed by both parties from the time the dispute arose, Both Parties agree that the settlement will be resolved by BANI (Indonesian National Arbitration Board) located at Jakarta. BANI’s decision is final, and no further settlement at a higher level and is binding Both Parties can be requested.
10. Applicable Law
These terms are governed by the laws of the Republic of Indonesia. Any matters that are not and have not been regulated in these Terms and Conditions are governed by any regulations to the subject of Agreement, including but not limited to the Law of the Agreement in Book III, Indonesian Civil Codes (KUHPerdata).
11. Effective Date
This Terms and Conditions Agreement, issued by Apilogy and accepted by you, is effective as of 30 June 2024.
